Real Estate Matters

Muir represents parties in lawsuits, arbitrations and mediations on issues related to breach of contract, fraud, disclosure, misrepresentation, co-ownership, easements, boundaries, encroachments, title insuarance claims, construction defects, commission and escrow disputes, professional negligence including broker and property manager liability, elder financial abuse, CC&Rs, HOA's, Department of Real Estate licensee matters, landlord and tenant, eviction, foreclosure, financing, and insurance.

Muir advises buyers, sellers and real estate licensees on residential and commercial real estate sales, purchases and leases, and prepares documents and agreements for these transactions, including deeds and easements.

Business and Commercial Matters

Muir represents individuals, partnerships and corporations including establishing business entities and advising on operations, preparing contracts on sale and purchase of businesses and properties, and handling a wide range of business disputes and litigation, including breach of contract, fraud, commercial lease disputes, collection of accounts, enforcement of judgments, and creditor representation.

Muir has been included in San Diego Magazine's annual list of "Top Attorneys" in San Diego each year since 2013.


In 1981, Robert Muir began practicing law in San Diego. For 15 years, Muir practiced with an "AV Rated" five-attorney civil litigation, business and real estate law firm in downtown San Diego. In 1999, Muir opened his own law firm in its current location.

Professional Activities

Muir served as an Arbitrator for the San Diego Superior Court (1994 - 2005) and American Arbitration Association (1988 - 1996) on business and commercial disputes. He was an instructor of contract law (1987 - 1990) and business law (1986 - 1987) at the University of California, San Diego Extension. He has made numerous presentations as a speaker and seminar panelist before professional groups including the San Diego County Bar Association, San Diego Association of Realtors, and National Conflict Resolution Center.

Muir has written over 25 legal articles that have appeared in San Diego Lawyer, Orange County Bar Journal, San Diego Realtor, Rental Owner (S. D. County Apartment Assoc.) and other professional publications. He is a past Chair (1987 and 1997) of the Realtor/Attorney Committee, a joint committee of the San Diego Association of Realtors (SDAR) and San Diego County Bar Association. Muir also serves on SDAR's Risk Management Committee (1992 - present) which develops real estate forms used in the County. Muir has been an Affiliate Member of SDAR since 1986, and was named Affiliate of the Year for 2011. Muir is also a member of the California and San Diego County Bar Associations.

Muir served as an intern to a United States Senator in Washington, D.C.; the Office of County Counsel, San Diego; and Office of City Attorney, San Diego. Muir also testified before a U.S. House of Representative Sub-Committee on an important real estate issue. He also serves as an expert witness on real estate issues and holds a real estate broker license.


Muir obtained his Bachelor's degree, with departmental High Honors, in 1975 and Master's degree in 1976 from the University of Hawaii. He completed his law degree at California Western School of Law in 1980, receiving the I.H. Prinz Medal Competition Award and American Jurisprudence Award.

In 1987, Muir completed Trial Advocacy (30 hours) and Evidence Workshop (14 hours), a certificate program by the San Diego Inn of Court.

In 2003, Muir completed Introductory Mediation Skills Training, a certificate program, through the San Diego Mediation Center (32 hours).

In 2007, Muir completed Trial By Masters presented by the American Board of Trial Advocates, San Diego Chapter (6.5 hours).

In 2011, Muir completed Real Estate Mediation training by the Straus Institute for Dispute Resolution, Pepperdine University School of Law (4.5 hours)
